Criminal Law
Criminal law maintains order in society, dealing with homicide, illegal drugs, theft, and other antisocial behavior. For any criminal case the legal procedure involves charging, trying, sentencing and imprisoning defendants convicted of crimes. So, criminal law regulates how suspects are investigated, charged and tried.
Criminal law is typically enforced by the government. The state initiates the suit through a prosecutor.
Perhaps the most consistent difference between Civil and Criminal law is the certainty of proof necessary to find a defendant guilty. Crimes – violations of the state or federal criminal laws – must be proved beyond a reasonable doubt (вне всякого разумного сомнения).
Depending on the offence and the jurisdiction, various punishments are available to the courts. A court may sentence an offender to execution, corporal punishment or loss of liberty – imprisonment, suspend the sentence; impose a fine; put the offender under government supervision through parole or probation; or place them on a community service order.
Civil Law
Compensating individuals who have been injured physically or economically is a civil law problem. Civil lawsuits involve personal injury, business disputes, land deals and various other commercial interests. In a civil case the victim (the plaintiff) brings the suit against the wrongdoer (the defendant).
Criminal courts can take away a person’s freedom and even life. The civil courts usually take away the defendant’s money or prohibit certain conduct.
In certain situations, the court has the right to order a person be prevented from or required to do something. This order is called injunction. To obtain a temporary injunction, the plaintiff must show that the defendant’s actions would cause irreparable harm. Temporary injunctions are frequently used in environmental law disputes, such as attempts to stop cutting of national forests. Violating an injunction is contempt of court and may be punished by a fine or imprisonment.
