Эти две стороны немедленно возобновят переговоры по постоянному статусу на ускоренной основе и приложат решительное усилие, чтобы достигнуть взаимной цели по достижению соглашения к 4 мая 1999. Переговоры будут продолжаться без прерывания. США выразили свою готовность содействовать этим переговорам.

V. ОДНОСТОРОННИЕ ДЕЙСТВИЯ

Признавая необходимость создания благоприятных условий для переговоров, ни одна из сторон не должна инициировать или принимать какие-либо шаги, которые изменят статус Западного берега реки Иордан и Сектора Газа в соответствии с Временным соглашением.

Wye River Memorandum

October 23, 1998

Described further - steps to facilitate the implementation of the Interim Agreement on the West Bank and the Gaza Strip of 28 September 1995 (the "Interim Agreement") and other related agreements, including the Cautionary Note Records from January 17, 1997 (hereinafter referred to as "prior agreements") to Israel and the Palestinian side can better fulfill their mutual obligations, including those relating to the further redeployment and security, respectively. These steps must be performed in parallel phased approach in accordance with this Memorandum and the accompanying time frame. They are governed by the terms of previous agreements and do not replace them with other requirements.

I. Further redeployment

A. Phase one and phase two further relocations

1. In accordance with the Interim Agreement and subsequent agreements, the implementation of the Israeli side of the first and second FRD will consist of Palestine transmission side 13% of area C as follows:

1% to (A)

To 12% (B)

The Palestinian side has informed that it will appoint a province / region, constituting 3% of the above-mentioned areas (B), to determine how green the area and / or Reserves. The Palestinian side has further advised that they will act in accordance with established scientific standards, and that therefore there will be no change in the status of these regions, without causing prejudice to the rights of existing residents in these areas, including the Bedouin, while these standards do not allow new construction in these areas, it will be supported by the existing roads and buildings.

The Israeli side will retain in these areas of the Green / Nature Reserves the overriding security responsibility for protecting Israelis and confronting the threat of terrorism. Operations and movements of Palestinian police can be performed after coordination and confirmation, the Israeli side will respond promptly to such requests.

2. As part of the above-mentioned first and second F.R.D., 14.2% of the area (B) will be the area (A).

B. The Third Phase of the further redeployment

As for the conditions of the Interim Agreement and the documents Secretary Christopher for the two sides of the January 17, 1997, which related to the further process of redeployment, will set up a committee to address this issue. The United States will be regularly informed.

II. SAFETY

The provisions on security measures of the Interim Agreement Palestinian side agreed to take all necessary measures to prevent acts of terrorism, crime and hostilities directed against the Israeli side, against individuals falling under the authority of the Israeli side and against their property, as well as Israeli side agreed to take all necessary measures to prevent acts of terrorism, crime and hostilities directed against the Palestinian side, against individuals falling under the authority of the Palestinian side and against their property. Both parties recognize that it is in their best interest to fight against terrorism and the fight against violence, in accordance with Annex I of the Interim Agreement and the Note to the records. They also recognize that the fight against terrorism and violence must be comprehensive with regard to all that relates to terrorists and terrorist support structures, and to the environment, conducive to support terror. This should be a continuous and constant over a long period, and there can be no pauses in the work of terrorists and their organizations. This must be conducted jointly, no effort can not be fully effective without Israeli-Palestinian cooperation and continuous exchange of information, concepts, and actions.

In accordance with previous agreements, the implementation of the Palestinian side of its obligations under the Security Cooperation in the field of security, and other issues will occur, as described in the terms specified in the attached timeline:

A. Safety Actions

1. Declared an outlaw and combat terrorist organizations

a. The Palestinian side will inform its policy of zero tolerance for terror and violence on both sides.

b. The work plan developed by the Palestinian side will be shared with the U.S., and then begin immediate implementation to ensure systematic and effective combat terrorist organizations and their infrastructures.

c. In addition to the bilateral Israeli-Palestinian security cooperation US-Palestinian committee will meet every two weeks to review the steps taken to eliminate terrorist cells and structures to support that plan, finance, supply and abets terror. In these it has taken to outlaw all organizations (or wings of organizations as appropriate) military, terrorist or violent nature and structure to support them and prevent them to work in areas under its jurisdiction.

d. The Palestinian side will arrest certain individuals who are suspected of acts of violence and terror in order to further the investigation and trial, and punishment of all those involved in acts of violence and terror.

e. US-Palestinian committee will meet to review and evaluate the information that is relevant to the judgment, punishment or other legal measures that affect the status of individuals suspected of committing or abetting acts of violence and terror.

2. Prohibition of Illegal Weapons

a. The Palestinian side will provide an effective legal framework in the field, to criminalize, in accordance with previous agreements, any importation, manufacturing or unlicensed sale, possession or purchase of firearms, ammunition or weapons in areas under Palestinian jurisdiction.

b. In addition, the Palestinian side will establish and vigorously and continuously implement a systematic program for the collection and proper treatment of all such illegal items in accordance with previous agreements. United States agreed to assist in the implementation of this program.

c. US-Palestinian-Israeli committee will be established to assist and strengthen cooperation to prevent smuggling or other unauthorized use of weapons or explosive materials in the area under Palestinian jurisdiction.

3. Preventing Incitement

a. Drawing on relevant international practice and in accordance with Article XXII (1) of the Interim Agreement and the Notes to Records, the Palestinian side shall issue a decree prohibiting all forms of incitement to violence or terror, and establishes mechanisms to act systematically against all expressions or threats of violence terror. This decree will be comparable to the existing Israeli law, which deals with the same subject.

b. US-Palestinian-Israeli committee will meet on a regular basis to monitor cases of possible incitement to violence or terror and to provide recommendations and reports on how to prevent such incitement. Israeli, Palestinian and American sides each appoint a media specialist, a law enforcement officer, teacher, and current or former elected official on the committee.

B. Security cooperation

The two parties agree that their security cooperation will be based on a spirit of partnership and will include, among other things, the following:

1. Bilateral cooperation

Between the two sides will complete bilateral cooperation in the field of security, which will be a constant, intense and comprehensive.

2. Judicial Cooperation

There will be an exchange of judicial practice, training, and other assistance.

3. The Tripartite Committee

In addition to the bilateral Israeli-Palestinian security cooperation ranking US-Palestinian-Israeli committee will meet as needed and not less frequently than once every two weeks to assess current threats to resolve any obstacles to effective security cooperation and coordination as well as to address the steps that must be taken to combat terrorism and terrorist organizations. The Committee will also serve as a forum to address the problem of external support terror. At these meetings, the Palestinian side will inform the Committee about the results of investigations relating to terrorist suspects already in custody, and the participants will share additional relevant information. The Committee will regularly report to the leaders of the two sides on the status of cooperation, the results of the meeting and its recommendations.

C. Other matters

1. The Palestinian Police

a. The Palestinian side will provide a list of its officers of the Israeli side in accordance with previous agreements.

b. If the Palestinian side request technical assistance, the United States declared its willingness to help meet these needs, in collaboration with other organizations..

c. Committee for the Control and Management as part of its functions, will oversee the implementation of this provision and to inform the United States.

2. The Charter of the Palestine Liberation

The Executive Committee of the Palestine Liberation Organization and the Palestinian Central Council will reaffirm the document on 22 January 1998 from the Chairman of the Palestine Liberation Organization, Yasser Arafat, President Clinton regarding cancellation provisions of the Palestine National Charter, which are at odds with the documents exchanged between the PLO and the Israeli government 9/10 September 1993. Palestine Liberation Organization Chairman Arafat, the Speaker of the Palestinian National Council, and the Speaker of the Palestinian Council will invite members of the PNC, as well as members of the Central Council, the Council, and the Palestinian Heads of Ministries c to meet President Clinton to reaffirm their support for the peace process and the above-mentioned decisions of the Executive Committee and the Central Council.

3. Legal Assistance in Criminal Matters

Among other forms of legal assistance in criminal matters requests for arrest and surrender of suspects and accused persons in accordance with Article II (7) of Annex IV of the Interim Agreement will be submitted (or resubmitted) through the mechanism of a joint Israeli-Palestinian Judiciary Committee, and the answer will be given in According to Article II (7) (F) in Annex IV of the Interim Agreement for twelve weeks. Requests submitted after the eighth week, will answer in accordance with Article II (7) (f) within four weeks of their submission. The parties requested the United States to report on a regular basis on the steps taken to respond to the above requests.

4. Human Rights and Rule of Law

In accordance with Article XI (1) of Annex I of the Interim Agreement, and without prejudice to the above, the Palestinian police use of the powers and responsibilities to execute this Memorandum with due regard to internationally accepted standards of human rights and the rule of law, and will be the knowledge of the need to protect the public, respect human dignity, and prevent harassment.

III. TEMPORARY COMMITTEES AND ECONOMIC ISSUES

1. Israeli and Palestinian sides reaffirmed their commitment to strengthen their relationship and agreed on the need to actively promote economic development in the West Bank and the Gaza Strip. In this regard, the parties agree to continue or resume all standing committees established by the Interim Agreement, including the Committee for the Control and Management, the Joint Economic Committee (JEC), the Committee on Civil Affairs (CAC), the Legal Committee and the Permanent Committee on Cooperation.

2. Israeli and Palestinian sides have agreed on measures to ensure the timely opening of the Gaza Industrial Estate. They also signed a "Protocol on the establishment and work of the international airport in the Gaza Strip during the interim period."

3. Both sides to immediately resume negotiations relative safety checkpoint. As for the southern route, the parties will make every effort to conclude an agreement within a week after the entry into force of this Memorandum. The work of the southern route then start as soon as possible. As for the northern route, the negotiations continue in order to reach an agreement as soon as possible. After this exercise will be carried out promptly.

4. Israeli and Palestinian sides recognize the great importance of the Port of Gaza for the development of the Palestinian economy, and the expansion of Palestinian trade. They dedicate themselves to promptly enter into a contract to continue to allow the construction and operation of the port, in accordance with previous agreements. The Israeli-Palestinian Committee to immediately revive its work with a view to concluding the protocol within sixty days, which will begin construction of the port.

5. The two sides recognize that unresolved legal issues have a negative impact on relations between the two nations. Therefore, they will continue to build through the Legal Committee to resolve outstanding legal issues and the implementation of solutions for these issues as soon as possible. The Palestinian side will provide the Israeli side copies of all applicable laws.

6. Israeli and Palestinian sides will also begin a strategic economic dialogue to improve their economic relations. To this end they shall set up within the framework of the Special Committee of the JEC. The Committee will consider the following four questions: (1) Israeli indirect taxes on purchases, and (2) cooperation in the fight against theft of transport, (3) dealing with unpaid Palestinian debts, and (4) the impact of the Israeli standards as barriers to trade and expand the lists A1 and A2. The Committee will issue an interim report within three weeks after the entry into force of this Memorandum, and within six weeks will present its findings and recommendations to be implemented.

7. The two parties agree on the importance of long-term funding of international aid organizations, to facilitate the implementation of the agreements reached by both parties. They also recognize the need for improved donor support economic development in the West Bank and the Gaza Strip. They agree to jointly appeal to the community of donors to organize a Ministerial Conference before the end of 1998 to search for a loan to improve the levels of care.

IV. NEGOTIATIONS ON PERMANENT STATUS

The two sides immediately resume permanent status negotiations on an accelerated basis, and will make a determined effort to achieve the mutual goal of reaching an agreement by May 4, 1999. The talks will continue without interruption. U.S. has expressed its willingness to facilitate these negotiations.

V. Single-acting

Recognizing the need to create favorable conditions for negotiations, neither party shall initiate or take any step that will change the status of the West Bank and the Gaza Strip in accordance with the Interim Agreement.

APPENDIX: Timeline

This Memorandum will come into force ten days after its signing.
