A prisoner (inmate, detainee) is a person who is deprived of liberty against his or her will. This can be by confinement, captivity, or by forcible restraint.

"Prisoner" is a legal term for a person who is imprisoned. In the Prison Security Act 1992 of English legislative, the word "prisoner" means any person for the time being in a prison as a result of any requirement imposed by a court or otherwise that he be detained in legal custody.

In the Unites States of America both federal and state laws govern the rights of prisoners. Prisoners in the United States do not have full rights under the Constitution, however, they are protected by Amendment VIII which prohibits cruel and unusual punishment.

In the Russian Federation, the legal status of prisoners is regulated by the Criminal Executive Code of the Russian Federation and other federal legislation. The Russian Federation respects and protects the rights, freedoms and legitimate interests of prisoners, ensures the legality of the use of their remedies, their legal protection and personal security in the execution of sentences. Prisoners have equal rights and responsibilities.

Prisoners are required to comply federal laws that determine the procedure and conditions for serving sentences. Prisoners are required to comply the legal requirements of the administration of state bodies that execute sentences. Prisoners are obliged to be polite towards staff, other persons attending penal institutions, as well as other prisoners. Prisoners are required to appear at the call of the administration of the state institutions and bodies that carry out sentences, and give explanations on the execution of the requirements of the sentence.

Prisoners persons have the right to receive information about their rights and responsibilities, about the procedure and conditions for serving the type of punishment prescribed by the court. Prisoners have the right to courteous treatment on the part of the staff of the institution executing sentences. Prisoners, regardless of their consent, may not be subjected to medical, scientific or other experiments related to the testing of drugs, new methods of diagnosis, prevention and treatment of diseases, as well as biomedical research. Prisoners have the right to protection of their health, including the receipt of first health care and specialized medical care. Prisoners have the right to social security, including the receipt of pensions and social benefits, according to the legislation of the Russian Federation.

The activity of the entire Russian penitentiary system is controlled by the Federal Penitentiary Service of the Russian Federation, which reports to the Ministry of Justice.
